Hiding from Humanity: Disgust, Shame, and the Law
Categories: Law, Politics & Social Sciences
Hiding from Humanity (2004) is a work of philosophy and law by Martha C. Nussbaum on the role of disgust and shame in legal decisions. Nussbaum argues that, unlike anger or fear, these emotions are unreliable guides for the law because they rest on a wish to hide from our own animal nature and often target minorities, gay people and the poor. She examines cases involving obscenity, sodomy laws and shaming penalties, and makes the case for a liberal legal order that protects human dignity.
